MILCON, Military Construction And VA Construction Representation

Our firm represents Sureties in bond defaults when the U.S. Government is the Obligee. We have successfully represented Sureties in takeover agreements with the U.S. Army and the U.S. Veterans Administration. Our attorneys have successfully represented Sureties and Federal Contractors with claims before the U.S. Court of Claims. We have represented Sureties and Contractors in cases involving the construction of facilities for the U.S. Army Corps of Engineers, the National Guard, U.S. Navy Facilities Command and the U.S. Veterans Administration.

Our recent success in military construction contracts includes $850 million dollars in ongoing military construction contracts — which we novated as part of an asset sale of a large government contractor.

We recently assisted a national contractor with the novation of an Indefinite Delivery Indefinite Quantity (IDIQ) Multiple Award Construction Contract (MACC) and successfully assisted clients in obtaining recognition of entity name changes.

Ethics And Conduct

The Federal Acquisition Regulation was amended to include the Code of Business Ethics and Conduct. The Code is found at 48 CFR 52.203-13 and requires government contractors to self-report ethics violations to the government accountability office or the Department of Defense Inspector General.

Many businesses are encountering obstacles in this area of law and need representation from an attorney who understands the Code and can provide educational insight into the processes required. We have extensive experience in military construction contracts and over the years have developed strong relationships with resources and other parties.

False Claims Act

The enactment of the Fraud Enforcement and Recovery Act of 2009 substantially altered the government’s most powerful tool in its arsenal — the False Claims Act (FCA). FCA litigation requires skilled and experienced counsel. Our attorneys work closely with clients to formulate a cost effective strategy of defending these claims. Our FCA litigators have successfully represented defendants in FCA qui tam litigation.
